Terms of Service

1. Eligibility

You must be at least 17 years of age to use Stack43. By using the Service, you represent and warrant that you meet this age requirement. We do not knowingly allow users under 17 to create accounts. If we become aware that we have collected information from a user under 17, we will delete that account.

2. Your Account

When you create an account, you agree to: provide accurate and complete information during registration; keep your login credentials secure and not share them with others; notify us promptly at support@stack43.com if you suspect unauthorized access; be responsible for all activity that occurs under your account. We reserve the right to suspend or terminate your account if any information you provide is false or in violation of these Terms.

3. User Content

You retain ownership of all photos, videos, captions, and comments you post. By posting, you grant Stack43 LLC a non-exclusive, royalty-free, worldwide license to store, display, and distribute your content solely to operate the Service. We will not sell your content. You agree not to post content that is illegal, harmful, harassing, or defamatory; infringes third-party rights; contains nudity or graphic violence; promotes self-harm or substance abuse; or constitutes spam or impersonation.

4. Content Moderation and Safety

Stack43 provides tools to help maintain a safe community:

• Reporting: You can report any post or user for spam, inappropriate content, harassment, misinformation, or other concerns through the in-app menu.
• Blocking: You can block any user, which will hide their content from you and prevent them from interacting with your content.
• Removal: We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or inappropriate. We may take action without prior notice.

We aim to review reports within a reasonable time but do not guarantee any specific response time.

5. Acceptable Use

You agree not to attempt unauthorized access to any part of the Service; scrape or extract data using automated tools; interfere with the Service's performance; or harass other users.

6. Intellectual Property

The Stack43 name, logo, and all related materials are the property of Stack43 LLC. Nothing in these Terms grants you the right to use our trademarks without prior written consent.

7. Privacy

Your use of the Service is governed by our Privacy Policy at stack43.com/privacy.

8. Termination

You may delete your account at any time through app settings. We may suspend or terminate your access at any time for violation of these Terms, fraudulent activity, or conduct harmful to other users.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STACK43 LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS.

11. Governing Law

These Terms are governed by the laws of the State of New Jersey.

12. Changes

We may update these Terms from time to time. Continued use after changes constitutes acceptance.

13. Apple App Store Additional Terms

If you downloaded Stack43 from the Apple App Store, the following additional terms apply:

Acknowledgment. These Terms are between you and Stack43 LLC only, not with Apple Inc. ("Apple"). Stack43 LLC, not Apple, is solely responsible for the Service and its content.

Scope of License. The license granted to you for Stack43 is limited to a non-transferable license to use the app on Apple-branded products you own or control, subject to the Apple App Store Terms of Service.

Maintenance and Support. Stack43 LLC is solely responsible for providing any maintenance and support services for the Service. Apple has no obligation to furnish any maintenance or support.

Warranty. Stack43 LLC is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Service.

Product Claims. Stack43 LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the Service, including product liability claims, claims that the Service fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.

Intellectual Property Rights. Stack43 LLC will be solely responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim related to the Service.

Legal Compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Beneficiary. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
